Terms of Service

1 · Provider and scope

These terms apply to the Hytive app and related account services provided by Bent Eisheuer, Freisinger Landstraße 47a, 85748 Garching, Germany. Contact: support@hytive.app. The public website has no checkout. Any subscription is offered through the Apple App Store.

2 · Account and age

You must be at least 16 years old and provide accurate information. Keep your sign-in method secure and tell us promptly if you suspect unauthorized access. Your account remains available if you decline optional health consent, although features that require that processing cannot operate.

3 · Service and acceptable use

Hytive lets you plan and record training, import supported fitness data and view deterministic load, readiness and recovery estimates. Do not use the service unlawfully, interfere with its security or availability, access another account, or upload content you lack the right to use. We may restrict affected access where reasonably necessary to protect users or the service and will consider the circumstances and your legitimate interests.

4 · Your content

You retain your rights in content you submit. You grant us only the non-exclusive rights necessary to host, process, back up and display it according to your chosen settings. You can export data and delete your account in the app. Details are in the Privacy Policy.

5 · Free launch access and future subscriptions

Free during our launch period. Hytive will introduce subscriptions later. No date has been set. We’ll explain the price and any changes to access in advance. You’ll only pay if you choose a subscription.

Launch access requires no payment details and does not automatically convert to a paid subscription. This notice describes our plans; it does not authorize charges or give us a blanket right to end or restrict your existing access. Any later change must respect your contract and statutory rights. We will explain its date, scope, available choices and applicable rights in advance, including by a durable medium where required. Declining a future subscription does not itself authorize us to withdraw access you are entitled to keep.

Du zahlst nur, wenn du dich für ein Abo entscheidest. Es gibt keine automatische Umstellung auf ein kostenpflichtiges Abo. Dieser Hinweis berechtigt uns nicht pauschal, bestehenden Zugang zu beenden oder einzuschränken. Deine vertraglichen und gesetzlichen Rechte bleiben gewahrt.

Future purchases and cancellation

Before a purchase, the App Store shows the seller, exact localized total price, billing period, included features, any trial and its conversion terms, and renewal conditions. Your order is not placed through this website. Apple processes payment, renewal, cancellation and eligible refunds under the applicable App Store terms. You can manage or cancel a subscription in your Apple account settings. Cancellation takes effect as shown there and does not normally end access already paid for.

6 · Statutory consumer rights

Nothing in these terms excludes mandatory rights concerning digital products, conformity, remedies, updates, withdrawal, refunds or damages. Where applicable, information and consent concerning early performance and any resulting loss of a withdrawal right are presented in the actual purchase flow and confirmed on a durable medium by the contractual seller.

7 · Availability and changes

We may maintain, secure and improve Hytive. We will not remove paid core features or make a material detrimental contract change without a valid reason, clear prior notice where required, and the rights mandatory law provides. Temporary disruption can still occur through maintenance, security incidents or infrastructure failure.

8 · Liability

We are liable without limitation for intent and gross negligence; injury to life, body or health caused intentionally or negligently; guarantees we expressly give; fraudulent concealment; and liability under mandatory law, including product liability law. For slight negligence affecting an essential contractual duty, our liability is limited to the foreseeable loss typical for this type of contract. Otherwise, liability for slight negligence is excluded to the extent legally permitted. These limits do not reduce mandatory consumer remedies.

9 · Termination

You may stop using Hytive and delete your account in the app. Subscription cancellation is separate and takes place through the channel shown at purchase. We may terminate for material breach after appropriate notice and an opportunity to remedy where reasonable; immediate action remains possible for serious security or legal reasons. Mandatory rights remain unaffected.

10 · Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of mandatory protections of the country in which you habitually reside.
